Revised Florida Statutes Affect HOA Fining Procedure

In June, 2015, Florida Statutes Section 720.305 was changed requiring HOA’s to conform to a revised violation appeal process.  In general, the statues require the Board to assume fining decisions rather than the Fining Committee.  A Hearing Panel, a new entity, will hear appeals and approve or deny any fines levied.
